Bukujanji Terms of Service

1. About Bukujanji

Bukujanji is a marketplace platform operated by PT Bukujanji Indonesia ("Bukujanji", "we", the "Platform"). The Platform connects three parties: (a) Outlet Branches (venue partners), (b) Organizer Owners (organizers of classes and events), and (c) Participants (end consumers). Bukujanji acts as a marketplace agent; we are not a party to the contract between Organizer Owners/Outlets and Participants.

Bukujanji is registered with the Indonesian Ministry of Communication and Digital (Komdigi) as a Private-Sector Electronic System Provider (PSE) under PP 71/2019 and Permenkominfo 5/2020. We comply with Law No. 11/2008 as amended by Law No. 19/2016 (the ITE Law), Law No. 27/2022 (Personal Data Protection Law / UU PDP), and Permendag 31/2023 on PMSE licensing.

2. Acceptance of Terms

By registering, accessing, or using the Platform, you represent that: (a) you are at least 18 years old or accompanied by a lawful guardian, (b) you have legal capacity under the Indonesian Civil Code, and (c) you have read, understood, and agreed to these Terms of Service, the Privacy Policy, and other supplementary documents. If you do not agree, you must not use the Platform.

Acceptance is recorded electronically: a timestamp (tosAcceptedAt) and document version (tosVersion) are stored on your account. This record constitutes electronic evidence under Article 5 of the ITE Law.

3. Account Types

  • Participant Account — consumers who book classes, events, or packages. Can be created via email or WhatsApp; certain features (e.g. booking history) require login.
  • Organizer Owner Account — professional providers who sell classes/events/packages. Must complete KYC (ID card, selfie, NPWP if applicable, bank account) and accept the Seller Agreement (separate document).
  • Outlet Branch Account — venue partners registered as a legal entity (PT/CV/NIB-holding individual). Outlet accounts are governed by additional terms during onboarding.

One WhatsApp number / one ID card may control only one Organizer Owner Account. Multiple accounts or false identities may result in suspension.

4. Bookings and Payments

Payments are processed by Midtrans (PT Midtrans Payment Solutions, a Bank Indonesia-licensed PJSP). When a Participant pays for a ticket, funds are held in escrow until 24 hours after the event takes place, to ensure the event was actually delivered before disbursing to the Organizer Owner / Outlet.

Charges visible at checkout:

  • Ticket price — set by the Organizer Owner.
  • Payment gateway admin fee — pass-through from Midtrans, displayed as a separate line.
  • Promo discount — if a valid promo code is applied.

Bukujanji takes a marketplace fee of a defined percentage of the ticket price (default 3%) deducted at settlement, not charged to the Participant. Withholding tax (PPh 23 under Article 23 of the Income Tax Law) may be deducted from payouts depending on the seller entity's NPWP status: 2% with NPWP, 4% without, in line with PMK 141/2015.

5. Refunds and Cancellations

Refund rules follow the time-decay policy detailed in the Refund & Cancellation Policy document. Summary:

  • ≥ 48 hours before event: 100% refund.
  • 24–48 hours: 75% refund.
  • 6–24 hours: 50% refund.
  • < 6 hours: no refund (except force majeure or cancellation by the Organizer Owner).

If the Organizer Owner cancels the event, the Participant receives a 100% refund plus Bukujanji waives the marketplace fee for that transaction.

6. User Obligations

You agree to:

  • Provide truthful, complete, and current information.
  • Not impersonate others or submit false data (Article 35 of the ITE Law).
  • Not upload content that is unlawful, discriminatory, pornographic, false, or gambling-related (Articles 27–28 of the ITE Law).
  • Not reverse-engineer, scrape without consent, or intrude on systems (Article 30 of the ITE Law).
  • Comply with class/event rules set by Organizer Owners (e.g. health declaration, dress code, child consent).

Violations may result in temporary suspension, account termination, and/or reporting to law enforcement.

7. User Content

Organizer Owners and Participants may upload content (photos, descriptions, reviews, etc.). You warrant that you hold rights to the content uploaded, and you grant Bukujanji a non-exclusive, royalty-free, transferable license to display, distribute, and promote that content in the context of Platform services (including on Bukujanji's social channels). The license lasts while your account is active; on account deletion, we stop using the content unless a legal obligation requires retention.

8. Limitation of Liability

Bukujanji is a marketplace agent, not an event organizer, not a venue provider, not a medical/fitness professional. We are not responsible for:

  • The quality, safety, or fitness for purpose of classes organized by Organizer Owners.
  • Physical injuries or incidents during an event.
  • Acts of instructors, fellow participants, or third parties at the venue.
  • Indirect, consequential, or lost-profit damages.

Bukujanji's total liability (if proven negligent by a court of competent jurisdiction) is capped at the amount the Participant paid for the relevant transaction in the preceding 12 months. This clause does not limit consumer rights under Law No. 8/1999 (Consumer Protection Law) that cannot be excluded by contract.

9. Suspension and Termination

Bukujanji may suspend or terminate an account for material breach of these Terms, fraud indicators, or valid legal order. Before termination we attempt to contact you via email/WhatsApp for clarification, except in high-risk cases (active fraud, security threats).

You may close your account at any time via Settings → Delete Account. Closure does not erase transaction records that we are required to retain under tax law (10 years) and PSE regulations.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be announced via email and an in-app banner at least 14 days before they take effect. Use of the Platform after the effective date constitutes acceptance of the new version. Re-acceptance is requested via checkbox when the change is material.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Disputes that cannot be settled amicably will be resolved through the Badan Penyelesaian Sengketa Konsumen (BPSK) for consumer matters, or the District Court of South Jakarta for other matters, unless a specific forum is required by law.
